3. No Personalization — Simultaneous and Identical Distribution
We do not know, and do not take into account, any user’s financial situation, investment objectives, risk tolerance, time horizon, tax status, portfolio holdings, or any other personal circumstances.
All content — including alerts, regime readings, posts, videos, and other communications — is distributed identically and simultaneously to all users.
All alerts and outputs are purely mathematical readings based on historical data and predefined quantitative rules. They do not consider your objectives, financial situation, risk tolerance, time horizon, or individual needs. You alone are solely and exclusively responsible for every investment decision you make and for all resulting gains or losses.
4. No Discretion, No Auto-Execution, No Funds Management
Given Analytics does not exercise discretion over subscriber funds, does not auto-execute trades on behalf of any user, and does not manage, custody, or control client assets in any way.
You alone are responsible for placing, modifying, managing, or canceling any order with any broker, exchange, or trading venue.
5. Alerts, Conditions, and Model Outputs
Given Analytics monitors financial symbols and macroeconomic data using a rules-based mathematical framework that may include price structure, rate of change, risk behavior, participation, and macro context.
An alert or condition is a model classification indicating that predefined quantitative conditions have aligned under the framework’s rules at a point in time. It is an observation only.
An alert or condition is not:
- A recommendation.
- A prediction.
- A guarantee of any outcome.
- A directive to buy, sell, hold, enter, or exit.
- A statement about future performance.
- Any form of financial advice.
Every alert, post, video, and communication from Given Analytics carries the same status: MAY · POTENTIAL · EDUCATIONAL.
6. Hypothetical, Historical, and Model Outputs
Any historical patterns, regime associations, mathematical conditions, alerts, quotes, backtests, examples, or model outputs are shown for educational purposes only. Hypothetical and historical results have inherent limitations and are not indicative of future results. Actual market outcomes can and often do differ materially and unpredictably.

Unlike an actual performance record, simulated results do not represent actual trading. 8. Regime Framework Disclosure
Given Analytics may publish macroeconomic environment or regime readings derived from composites of publicly available economic and market data. These readings classify conditions into mathematical states under the framework, including but not limited to Expansion, Acceleration, Stagflation, and Contraction.
These readings are mathematical observations based on quantitative data. They are not forecasts, not predictions, and not investment advice.
Historical associations between regime states and asset behavior are presented solely for educational purposes. Regimes and environments can change rapidly and without warning. Regime readings may also lag real-world conditions because public economic data can be delayed, revised, or restated after publication.
9. Data, Delays, Third-Party Sources, and Revisions
All data, quotes, and observations may rely in whole or in part on third-party sources and are subject to delays, revisions, errors, omissions, and incompleteness.
We do not guarantee the accuracy, completeness, timeliness, reliability, or availability of any data, quote, reading, calculation, output, or service. Third-party data providers may revise historical data retroactively, which may change historical readings and model outputs.
All content is provided as of the time published and may later change without notice.
10. AI-Assisted Content Disclosure
Some content is produced with the assistance of artificial intelligence tools for drafting, summarizing, formatting, and editorial support.
All AI-assisted content is reviewed by humans for compliance with Given Analytics’ legal and editorial standards before publication. AI is not used to provide personalized financial advice or individualized investment recommendations.
The underlying mathematical calculations and rules-based model outputs are deterministic processes independent of any AI system.
11. No Warranties — “AS IS” and “AS AVAILABLE”
All content and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
To the maximum extent permitted by law, Given Analytics disclaims all warranties, including without limitation any warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, availability, and uninterrupted operation.
We do not warrant that the service will be uninterrupted, error-free, secure, or free from technical failure, delay, or interruption.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIVEN ANALYTICS, LLC, AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR OTHER DAMAGES, ARISING FROM OR RELATING TO YOUR USE OF, RELIANCE ON, OR INABILITY TO USE ANY CONTENT OR SERVICES.
Our total liability to you, if any, is strictly limited to the total subscription fees actually paid by you to Given Analytics in the thirty (30) days immediately preceding the event giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
13. Indemnification by You
You agree to indemnify, defend, and hold harmless Given Analytics, LLC, and its owners, officers, employees, contractors, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your use of our content or services.
- Your misuse of our content or services.
- Your breach of this document.
- Your violation of any law, regulation, or third-party right.
14. Governing Law and Exclusive Jurisdiction — Florida
This document and your use of Given Analytics are governed exclusively by the laws of the State of Florida, without regard to conflict-of-laws principles.
Any dispute, claim, or controversy arising out of or relating to this document or your use of Given Analytics shall be brought exclusively in the state or federal courts located in or serving Indian River County, Florida. You irrevocably consent to personal jurisdiction and venue in those courts and waive any objection based on forum non conveniens or improper venue.
15. Entire Agreement and Amendments
This document constitutes the entire agreement between you and Given Analytics regarding your access to and use of our educational content and services.
