This Privacy Policy (“Policy”) explains how Given Analytics, LLC (“Given Analytics,” “Company,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you use our website, the Atlas Terminal platform, our educational content and subscriptions, and related services (collectively, the “Services”). The Services are delivered through two separate proprietary systems — the Macro Engine and the Atlas Model — as described in our Terms of Service and Educational Disclaimer. This Policy is incorporated by reference into the Terms of Service; together with the Educational Disclaimer, they form the “Agreement.” By using the Services, you acknowledge that you have read and understood this Policy.

1. Information We Collect

1.1 Information You Provide Directly

We collect information you provide directly to us, including:

  • Account information: your name, email address, and password when you register an account.
  • Billing information: information related to your subscription purchases. Payment‑card details are processed by our payment processor (Stripe) and are not stored by Given Analytics.
  • Communications: the contents of messages you send us for support, billing, or other inquiries.
  • Preferences: settings and choices you make in your account, including email and notification preferences.

1.2 Information Collected Automatically

When you use the Services, we and our service providers may automatically collect:

  • Usage data: pages and content viewed, features used, time spent, and how you interact with the Services.
  • Device and log data: IP address, browser type and version, device identifiers, operating system, referring pages, and access dates and times.
  • Cookies and similar technologies: information stored using cookies, pixels, local storage, or similar technologies used to keep you logged in, remember your preferences, secure your session, and understand usage patterns.

1.3 Analytics Providers

We use analytics tools to understand how visitors and subscribers use the Services, including Google Analytics and analytics built into our publishing platform (such as Ghost), and we may use similar providers in the future. These tools may collect usage, device, and log data as described above. Where a provider sets its own cookies or processes data under its own terms, that provider’s privacy policy governs its processing.

2. How We Use Your Information

We use personal information to:

  • Provide, operate, maintain, and improve the Services, including delivery of Macro Engine and Atlas Model outputs and your account experience.
  • Process subscriptions, payments, renewals, and refunds through Stripe.
  • Send service and transactional communications, such as billing, renewal, and security notices.
  • Send newsletters, product updates, and promotional email where permitted, from which you may unsubscribe at any time.
  • Respond to your support requests and inquiries.
  • Analyze usage and trends to improve content, features, and performance.
  • Detect, investigate, prevent, and address security incidents, fraud, and abuse.
  • Enforce the Terms of Service and comply with legal and regulatory obligations.

3. Payment Processing and Stripe

We use Stripe, Inc. (“Stripe”) to process payments for the Services. When you subscribe or make a payment, Stripe collects and processes your payment information, which may include your name, email address, billing address, and payment‑method details, in order to complete the transaction and to provide payment services.

Stripe shares certain transaction data with us, such as the fact of payment, subscription status, and limited billing metadata, so we can manage your subscription and account. Stripe’s processing of your information is governed by Stripe’s own privacy policies and terms. We disclose that we share your information with Stripe so Stripe can provide payment services, and we rely on Stripe’s certifications and contractual commitments, including its data‑processing and security obligations, for the payment information it handles.

4. How We Share Information

We do not sell your personal information. We share personal information only in the following circumstances:

  • Service providers: with vendors acting on our behalf, such as payment processing (Stripe), website hosting and content delivery, email delivery, analytics, and customer‑support tools. These providers may access personal information only to perform services for us and are expected to protect it.
  • Legal and safety: when we believe disclosure is required by law, regulation, legal process, or governmental request, or when we believe it is necessary to protect the rights, property, or safety of Given Analytics, our users, or others, or to detect or prevent fraud or security issues.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case personal information may be transferred as part of the transaction and remain subject to this Policy (or a successor policy that is materially similar).
  • With your direction or consent: when you ask or authorize us to share information with a third party or otherwise consent to sharing.

5. Cookies and Tracking Technologies

We and our service providers use cookies and similar technologies (such as pixels and local storage) to operate and improve the Services. These may include:

  • Strictly necessary cookies that keep you logged in and secure your session.
  • Functional cookies that remember your preferences and settings.
  • Analytics cookies that help us understand usage and performance.

You can control cookies through your browser settings; disabling or blocking some cookies may affect how the Services function. Where required by law, we will seek consent for non‑essential cookies and similar technologies.

6. Data Retention

We retain personal information for as long as your account is active and as long as necessary to provide the Services. After you cancel or close your account, we retain personal information only as necessary to:

  • Comply with legal, tax, and accounting obligations.
  • Resolve disputes and enforce our agreements.
  • Detect and prevent fraud and abuse.

After the applicable retention period, we delete or de‑identify personal information in a manner consistent with applicable law and our data‑retention practices.

7. Your Choices and Privacy Rights

7.1 Email Preferences

You can opt out of newsletters and promotional email at any time by using the unsubscribe link in those messages or by adjusting your account settings. We may still send you transactional and service messages (such as billing, renewal, and security notices) necessary to provide the Services.

7.2 Access, Correction, and Deletion

Depending on your location, you may have rights to access, correct, update, delete, or receive a copy of your personal information, and to object to or restrict certain processing. 7.3 California Residents (CCPA/CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the right to:

  • Know the categories and specific pieces of personal information we collect and the purposes for which we use them.
  • Request deletion of personal information, subject to certain exceptions.
  • Correct inaccurate personal information.
  • Opt out of the “sale” or “sharing” of personal information, as those terms are defined under California law.

We do not sell your personal information and do not share it for cross‑context behavioral advertising as those terms are defined under California law. You may exercise your California privacy rights yourself or through an authorized agent by contacting privacy@givenanalytics.com. We will not deny Services, charge different prices, or provide a different level or quality of Services solely because you exercise your privacy rights.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, and alteration. Payment‑card data is handled by Stripe under its own security and PCI commitments.

No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will take steps to notify you and relevant authorities as required by applicable law.

9. Children’s Privacy

The Services are intended for adults 18 years of age and older, consistent with the Terms of Service. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it promptly. 10. International Users and Data Transfers

Given Analytics is based in the United States, and we process and store information in the United States. The Services are directed to users in the United States. If you access the Services from outside the United States, you understand and agree that your information will be transferred to, processed, and stored in the United States, where data‑protection laws may differ from those of your country.

The Services may contain links to third‑party websites or services that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. You should review the privacy policies of any third‑party websites or services you visit.

12. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the “Last Updated” date above and post the current version on our website. Where required by law, we will provide additional notice of material changes. Your continued use of the Services after an updated Policy takes effect constitutes acceptance of the revised Policy.
